What is a summary judgment?

A summary judgement is a special type of judgement entered in a lawsuit. A summary judgement is entered when the court decides that there are no disputed issues of material fact. In other words the case is fairly clear cut and the movent, the party that files the motion for summary judgement is entitled to the entry of a judgement as a matter of law. There are really two requirements. First, that the facts be fairly clear. Second, that the person filing the motion is entitled to entry of a judgement as a matter of law.
